What Same-Day Does Not Promise
- The state's approval time. We control when the filing is submitted. The state controls when it is reviewed. Each state page gives the state's typical processing where the state publishes it.
- A name that is taken. We check the name before submitting. If the state's records show a conflict, we tell you the same day and submit as soon as you pick another, rather than submitting a filing that will bounce.
- Newspaper publication. Arizona, Nebraska and New York require a notice after formation. That is arranged and paid by you with the newspapers; we flag it before you pay.
Same-Day Filing Questions
What does same-day actually mean?+
That we do our part the same business day. Order before 2 PM Eastern, and the name check, the drafted articles and the submission to your state's filing portal all happen that day. After the cutoff it is the next business day. The state's review starts once it has the filing and runs on the state's schedule.
Will my LLC be approved the same day?+
In some states, usually. Wyoming, Colorado, Kansas, Virginia and Missouri process online filings at or near the moment they are submitted, and Alabama, Vermont, Rhode Island and Oregon are typically within a day or two. Other states take a week or more regardless of how fast the filing arrives. Your state's page says what to expect, and we never promise the state's time.
Can you buy the state's own expedite for me?+
In the states that sell one, yes, at the state's published price added to the state line of your order and shown before you pay. Texas charges $750 for same-day and $500 for next-day review; Georgia $275 for same-business-day; California $750 same-day and $350 for 24-hour; Delaware $100 same-day. Many states have no expedite because their online filings already clear quickly.
What does same-day submission cost?+
$99 on top of the standard order, and only if you pick it. Next-business-day submission is $49. Standard orders go in within 3 business days at no extra charge. The state's fee is the same on every tier.
Does same-day apply on weekends?+
No. The cutoff is 2 PM Eastern on a business day. An order on Saturday is submitted Monday, which is still ahead of a standard order.
What if the state rejects the filing?+
If the state rejects the filing because of our mistake, we fix it and refile at no cost to you, and if it still cannot be filed we refund our service fee. If the rejection comes from information you gave us, we make one correction and refile with no extra service fee; any additional fee the state charges is yours. The name check and field review before submission are there so this rarely happens.
